– Counsels in the Abia state governorship saga has said that All Progressives Grand Alliance (APGA) Alex Otti cannot appeal on the matter – The counsels said that any appeal by Otti will amount to a “mere academic exercise”
Counsels in the ongoing hearing of the leadership tussle in the Abia gubernatorial election matter has said the candidate for the All Progressives Grand Alliance (APGA) Alex Otti cannot appeal on the matter.
During the hearing of the Abia state election matter at the Supreme Court on Tuesday, September 27, counsels to Sampson Ogah and Otti differently filed three motions seeking the leave from the apex court.
But in their objections, Wale Olanikpekun, counsel to the Abia state governor Okezie Ikpeazu and Alex Iziyion for Ogah said the APGA candidate’s application was not granted at the lower court. The also argued that the court had given a judgement on the application without any form of appeal from Otti or his counsels. They also said that Otti’s application become party in the matter cannot be heard at the apex court.
Olanikpekun said addressing an application after judgement have been given on the main matter is tantamount to a “mere academic exercise”.
Having heard the counsels’ submissions, the seven-man panel of justice led by Mahmud Tanko, however allowed Otti’s counsel Patrick Ekueto submit his application. Tanko however noted that the court will later decide whether such attempts amount to academic exercise as submitted by Olanikpekun.
On adopting the motions filed by the parties, the court adjourned the matter to allow counsels file their brief of arguments.
